The law recognizes that people's circumstances can change after a divorce is finalized. Accordingly, people are able to modify most orders dealing with custody, support, and visitation. I have been handling modifications of orders since 1991. I thoroughly understand the modification process and its requirements. Formalize a modification to protect yourself!
I urge clients, even if they agree to a proposed change, to go through the proper channels when modifying any type of order. If they do not, they are creating a situation where it is hard to prove anything to a judge in the future. The change will not be enforceable, because there is nothing to enforce from a legal standpoint. Therefore, you should seek the advice of a family law attorney with experience working with modifications to be sure the change is legal and enforceable.
